1. ​​​​​1.1. Les présentes conditions d’utilisation s’appliquent à l’utilisation du réseau wifi de Brussels South Charleroi Airport, le service permettant à l’utilisateur de se connecter à l’internet par le biais du réseau sans fil (‘Wifi’) (le “Service"). Telenet est le fournisseur de ce service pour la SA Brussels South Charleroi Airport. Telenet, en tant que sous-traitant, respecte vos données et les traite conformément à la politique de confidentialité de la SA Brussels South Charleroi Airport
2. 1.2. En utilisant le Service, l’utilisateur adhère explicitement à l’applicabilité et au contenu des conditions d’utilisation et s’engage à les respecter.
3. 1.3. Les conditions générales de la SA Brussels South Charleroi Airport et la Politique de protection de la vie privée s’appliquent également au « Service » pour autant qu’il n’y soit pas dérogé ci-dessous. L’utilisateur est censé avoir pris connaissance de ces documents et les avoir acceptés. Si ce n’est pas le cas, il ne peut pas continuer à utiliser le Service. L’accès au service s’effectue selon l’un des deux moyens listés ci-dessous :

• L’utilisateur peut accéder au service en se créant un compte personnel. Lors de son inscription, il est demandé à l’utilisateur de remplir les champs suivants : adresse email, prénom, nom, date de naissance, code postal, numéro de téléphone. Il doit également se créer un mot de passe. Pour finaliser son inscription, l’utilisateur doit enfin introduire le code qu’il aura reçu via un SMS.

 La SA BRUSSELS SOUTH CHARLEROI AIRPORT se réserve le droit d’annuler le compte si l’utilisateur n’a pas saisi correctement  ses données.

• 3.1.    La SA BRUSSELS SOUTH CHARLEROI AIRPORT met en œuvre tous les moyens dont elle dispose pour assurer l’accès au service dans les meilleures conditions même si elle ne peut garantir le débit et la rapidité du service.  En effet, le débit est dépendant, notamment, du nombre d’utilisateurs connectés simultanément, des services utilisés et de Telenet, fournisseur de la SA BRUSSELS SOUTH CHARLEROI AIRPORT.  
• 3.2.    La SA BRUSSELS SOUTH CHARLEROI AIRPORT n’est pas responsable des contenus accessibles par le réseau Internet et des dommages qui peuvent naitre de leur utilisation, à moins que ces dommages n’aient été causés intentionnellement par la SA BRUSSELS SOUTH CHARLEROI AIRPORT.
•  3.3.    La responsabilité de la SA BRUSSELS SOUTH CHARLEROI AIRPORT ne peut être engagée vis-à-vis de l’utilisateur du service :

-    En cas de mauvaise utilisation du service ;

-    En cas de non-respect de ses obligations ;

-    En cas de perturbation ou d’interruption ;

-    En cas de force majeure.  

• 3.4.    En aucun cas, la SA BRUSSELS SOUTH CHARLEROI AIRPORT, ne sera responsable des dommages directs ou indirects et/ou immatériels, prévisibles ou imprévisibles (incluant la perte de profits ou d'une chance,…) découlant de la fourniture et/ou de l'utilisation du « Service ».

4.1.    La SA BRUSSELS SOUTH CHARLEROI AIRPORT donne à l’utilisateur un droit temporaire, non exclusif, personnel et non transmissible d'utilisation du Service. Toute autre utilisation, contre paiement ou non, est interdite. Par conséquent, l’utilisateur n’a pas le droit de transmettre, de commercialiser, d'ouvrir au public ou de diffuser publiquement, de télécharger, de copier ou de reproduire le Service ou toute partie de ce Service, et ce de quelque manière que ce soit.

  4.2.    L’utilisateur s’engage à ne pas faire un usage du Service qui est contraire à l’ordre public ou aux bonnes mœurs, ou à des fins frauduleuses ou illégales. Vous vous engagez également à faire un usage normal du Service et de vous restreindre à toute activité inacceptable, y compris (mais non exclusivement) la distribution de virus, l’envoi excessif de spam emails et l’envoi ou l’échange de contenu illégal ou protégé par des droits de propriété intellectuelle.  

4.3.    Il est expressément rappelé qu’Internet n’est pas un réseau sécurisé. Dans ces conditions, il appartient à l’utilisateur de prendre toutes les mesures appropriées de façon à protéger ses propres données et/ou logiciels notamment de la contamination par d’éventuels virus circulant sur le réseau Internet ou de l’intrusion d’un tiers dans le système à quelque fin que ce soit, et de procéder à des sauvegardes préalablement et postérieurement à la mise en place des services. La SA BRUSSELS SOUTH CHARLEROI AIRPORT ne pourrait être tenue pour responsable d’une altération, d’un vol ou d’une perte de données personnelles lors de l’utilisation du service, ou consécutive à l’utilisation du service.

 4.4.    L’utilisateur reconnait être informé que l’intégrité, l’authentification et la confidentialité des informations, fichiers et données de toute nature qu’il souhaite échanger sur le réseau Internet ne peuvent être garanties sur ce réseau. L’utilisateur ne doit donc pas transmettre via le réseau Internet des messages dont il souhaiterait voir la confidentialité garantie de manière infaillible.

4.5.    S’agissant des sites, des produits ou des services accessibles sur le réseau Internet, l’utilisateur adressera directement aux fournisseurs du service concerné, toute réclamation relative à l’exécution des services rendus par ceux-ci ou à la vente des produits par ceux-ci.

5.1.    Par l’utilisation du Service, les données de l’utilisateur à caractère personnel sont inclues dans les fichiers de BRUSSELS SOUTH CHARLEROI AIRPORT. Ces données seront traitées pour les finalités décrites dans la Politique de protection de la vie privée (https://www.brussels-charleroi-airport.com/fr/privacy-policy).

 5.2.    Nous rappelons à l’utilisateur que, s’il se connecte au réseau wifi de Brussels South Charleroi Airport, via Facebook ou Google, la politique de protection de la vie privée de Facebook ou Google sera également d’application en ce qui concerne l’utilisation de leurs services.

Tout litige ou divergence relatif aux présentes Conditions générales sera soumis au droit belge et à la compétence exclusive du tribunal de commerce de l’arrondissement judiciaire du Hainaut, division de Charleroi. 

1. 1. These terms and conditions apply to the use of Brussels South Charleroi Airport’s WiFi network, a service allowing users to use the Internet via a wireless network (‘WiFi’) (the “Service”). Telenet supplies this service for Brussels South Charleroi Airport SA. As a subcontractor, Telenet respects your data and processes it in accordance with Brussels South Charleroi Airport SA’s confidentiality policy.
2. 2. By using the Service, the user specifically agrees with the applicability and content of the terms and conditions and undertakes to respect them.
3. 3. The general terms and conditions applied by SA Brussels South Charleroi Airport SA and the Privacy Policy also apply to the “Service” as long as they are not contradicted below. The user is supposed to have read these documents and accepted them. If this is not the case, they cannot continue to use the Service. The user can always consult BRUSSELS SOUTH CHARLEROI AIRPORT SA’s Privacy Policy at https://www.brussels-charleroi-airport.com/en/privacy-policy.

The service can be accessed according to one of the methods listed below:

• The user can access the “Service” by using their Google or Facebook account. In this case, they will be redirected to the Google or Facebook login page.
• The user can access the “Service” by creating an account. When they register, the user will be asked to complete the following fields: email address, first name, surname, date of birth, postcode, telephone number. They must also create a password. BRUSSELS SOUTH CHARLEROI AIRPORT SA will do everything it can to guarantee access to the service in the best possible conditions even if it cannot guarantee the speed of the service.  Indeed, the speed depends, among other things, on the number of users signed in at any time, which services are being used, and Telenet, BRUSSELS SOUTH CHARLEROI AIRPORT SA’s supplier.

3.2. BRUSSELS SOUTH CHARLEROI AIRPORT SA is not responsible for the content available online or for any damage that might arise from its use, unless this damage has been caused intentionally by BRUSSELS SOUTH CHARLEROI AIRPORT SA.

3.3. BRUSSELS SOUTH CHARLEROI AIRPORT SA cannot be held responsible in relation to the user of the service:

• If the service is not used properly;
• If the user has not fulfilled their obligations;
• If the service is disrupted or interrupted;
• In the event of force majeure

3.4. Under no circumstances will BRUSSELS SOUTH CHARLEROI AIRPORT SA be held responsible for direct or indirect damages, and/or intangible damages, whether foreseeable or not (including the loss of profit or opportunity etc.) resulting from the supply and/or use of the “Service”.

4.1.    BRUSSELS SOUTH CHARLEROI AIRPORT SA gives the user a temporary, non-exclusive, personal and non-transferable right to use the Service. Any other use, in return for a payment or not, is prohibited. As a result, the user does not have the right to transmit, market, open to the public or publicly disclose, download, copy or reproduce the Service or any part of this Service, in any way whatsoever.  

4.2.    The user undertakes not to use the Service in any way that is contrary to public order or acceptable standards of behaviour, or for fraudulent or illegal purposes. You also undertake to use this Service normally and refrain from any unacceptable activity, including (but not limited to) distributing viruses, sending spam emails and sending or sharing illegal content or content protected by intellectual property rights.  

4.3.    We would like to explicitly remind you that the Internet is not a secure network. Under these conditions, it is the user’s responsibility to take all appropriate measures to protect their own data and/or software, including in particular from contamination by any viruses on the Internet or a third-party hacker to the system whatever their intentions are, and to create backups before and after implementing the services. BRUSSELS SOUTH CHARLEROI AIRPORT SA cannot be held responsible for the distortion, theft or loss of personal data while or following on from using the Service.

 4.4.    The user acknowledges that they have been informed that the integrity, authentication and confidentiality of information, files and data of any kind that they would like to share on the Internet cannot be guaranteed on this network. The user must therefore not send messages via the Internet whose confidentiality they would like to be absolutely guaranteed.

 4.5.    For sites, products or services accessible on the Internet, the user will contact the suppliers of the service in question directly to make any complaint about the fulfilment of the services or sale of products by them.

5.1.    By using the Service, the user’s personal data is included in BRUSSELS SOUTH CHARLEROI AIRPORT files. This data will be processed for the purposes described in the Privacy Policy (https://www.brussels-charleroi-airport.com/en/privacy-policy).  

5.2.    We would like to remind users that, if they use Brussels South Charleroi Airport’s WiFi network, via Facebook or Google, Facebook or Google’s privacy policy will also apply to the use of their services.

Any dispute or difference of opinion relating to these General Terms and Conditions will be subject to Belgian law and the exclusive jurisdiction of the commercial court in the judicial district of Hainaut, Charleroi division. 

1.1.    Onderhavige gebruiksvoorwaarden zijn van toepassing op het gebruik van het wifinetwerk van Brussels South Charleroi Airport, de dienst waarmee de gebruiker zich kan verbinden met het internet via een draadloos netwerk (“Wifi”) (“de Dienst”). Deze dienst voor de NV Brussels South Charleroi Airport wordt geleverd door Telenet. Onderaannemer Telenet respecteert uw gegevens en verwerkt deze overeenkomstig de privacyverklaring van de NV Brussels South Charleroi Airport  

1.2.    Door gebruik te maken van deze Dienst, gaat de gebruiker expliciet akkoord met de toepasbaarheid en de inhoud van de gebruiksvoorwaarden en hij engageert zich om deze na te leven.  

1.3.    De algemene voorwaarden van de NV Brussels South Charleroi Airport en het Beleid tot bescherming van de persoonlijke levenssfeer zijn ook van toepassing op de “Dienst” voor zover hier niet van wordt afgeweken. Men gaat ervan uit dat de gebruiker kennis heeft genomen van deze documenten en dat hij ermee akkoord is gegaan. Indien dit niet het geval is, kan de gebruiker de Dienst niet blijven gebruiken. De gebruiker kan het Beleid tot bescherming van de persoonlijke levenssfeer van de NV BRUSSELS SOUTH CHARLEROI AIRPORT steeds raadplegen op https://www.brussels-charleroi-airport.com/nl/privacy-policy.

De toegang tot de Dienst is mogelijk op basis van één van de twee opties die hieronder worden opgelijst:  

• De gebruiker kan toegang krijgen tot de “Dienst” met behulp van zijn Google- of Facebook-account. In dat geval wordt hij doorverwezen naar de authenticatiepagina van Google of Facebook.
•  De gebruiker kan toegang krijgen tot de Dienst door een persoonlijk account te creëren. Tijdens zijn inschrijving wordt hij gevraagd om de volgende velden in te vullen: e-mailadres, voornaam, naam, geboortedatum, postcode en telefoonnummer. Hij moet ook een wachtwoord creëren. Om zijn inschrijving af te ronden, moet de gebruiker de code invoeren die hij via sms heeft ontvangen.

 De NV BRUSSELS SOUTH CHARLEROI AIRPORT behoudt zich het recht voor om de account van een gebruiker te annuleren indien deze zijn gegevens niet correct heeft ingevoerd.

3.1.    De NV BRUSSELS SOUTH CHARLEROI AIRPORT stelt alles in het werk om de toegang tot de Dienst onder de beste omstandigheden te garanderen, zelfs wanneer het debiet en de snelheid van de Dienst niet kan worden gegarandeerd.  Het debiet is namelijk voornamelijk afhankelijk van het aantal gebruikers dat gelijktijdig is verbonden met het netwerk, de diensten die worden gebruikt en Telenet, de leverancier van de NV BRUSSELS SOUTH CHARLEROI AIRPORT.  

3.2.    De NV BRUSSELS SOUTH CHARLEROI AIRPORT is niet verantwoordelijk voor de inhoud die toegankelijk is via het wifi-netwerk en de schade die kan resulteren uit zijn gebruik, voor zover deze schade niet bewust werd berokkend door de NV BRUSSELS SOUTH CHARLEROI AIRPORT.  

3.3.    De NV BRUSSELS SOUTH CHARLEROI AIPORT kan niet verantwoordelijk worden gesteld jegens de gebruiker voor de Dienst:

• In geval van verkeerd gebruik van de Dienst;
• In geval van niet-naleving van de verplichtingen;
• In geval van een storing of onderbreking;
• In geval van overmacht.  

3.4.    De NV BRUSSELS SOUTH CHARLEROI AIRPORT kan onder geen beding verantwoordelijk worden gesteld voor rechtstreekse of onrechtstreekse en/of immateriële schade, zowel voorspelbaar als onvoorspelbaar (met inbegrip van verlies van winst of een geluk...) die te wijten is aan de levering en/of het gebruik van de “Dienst”.

4.1.    De NV BRUSSELS SOUTH CHARLEROI AIRPORT verleent de gebruiker een tijdelijk, niet-exclusief, persoonlijk en niet overdraagbaar gebruiksrecht voor de Dienst. Elk ander gebruik, al dan niet tegen betaling, is verboden. Bijgevolg beschikt de gebruiker niet over het recht om de Dienst of elk gedeelte van deze Dienst over te dragen, te commercialiseren, te openen voor het publiek of om hem publiekelijk te verspreiden, te downloaden, te kopiëren of te reproduceren, en dit op welke manier dan ook.  

4.2.    De gebruiker engageert zich om geen gebruik te maken van de Dienst als dit in strijd is met de openbare orde of de goede zeden, of omwille van frauduleuze of illegale doeleinden. U engageert zich tevens om de Dienst normaal te gebruiken en afstand te nemen van elke onaanvaardbare activiteit, met inbegrip (maar niet beperkt tot) de verspreiding van virussen, het excessief versturen van spam en het versturen of uitwisselen van illegale inhoud of informatie die wordt beschermd door intellectuele eigendomsrechten.  

4.3.    Er wordt expliciet aan herinnerd dat het Internet geen beveiligd netwerk is. In deze omstandigheden, is het de taak van de gebruiker om alle gepaste maatregelen te treffen om zijn persoonsgegevens en/of software te beschermen, met name tegen de besmetting door eventuele virussen die circuleren op het internet of de inbraak door een derde partij in zijn systeem voor welke reden dan ook, en om voor en na het gebruik van de Diensten een back-up te maken. De NV BRUSSELS SOUTH CHARLEROI AIRPORT kan niet verantwoordelijk worden gesteld voor elke wijziging, diefstal of verlies van persoonsgegevens tijdens het gebruik van de Dienst of na het gebruik van de Dienst.  

4.4.    De gebruiker erkent dat hij werd geïnformeerd over het feit dat de integriteit, authenticatie en de vertrouwelijkheid van de informatie, bestanden en gegevens van welke aard dan ook die hij wenst uit te wisselen via het internet niet kan worden gegarandeerd op dit netwerk. We raden de gebruiker daarom aan om geen berichten te delen via het internet die hij vertrouwelijk wilt houden, aangezien de garanties nooit waterdicht zijn.  

4.5.    Of het nu gaat om websites, producten of diensten die toegankelijk zijn via het internet, de gebruiker dienst zich rechtstreeks tot de leveranciers van de betrokken Dienst te richten voor elke klacht met betrekking tot de uitvoering van de dienstverleningen die door hen worden aangeboden of de verkoop van producten via voornoemde leveranciers.

5.1.    Door gebruik te maken van de Dienst, worden de persoonsgegevens van de gebruiker opgenomen in de bestanden van BRUSSELS SOUTH CHARLEROI AIRPORT. Deze gegevens zullen worden verwerkt voor de doelen die worden omschreven in het Beleid tot bescherming van de persoonlijke levenssfeer (https://www.brussels-charleroi-airport.com/nl/privacy-policy).  

5.2.    We herinneren de gebruiker eraan dat, wanneer hij zich aanmeldt op het wifi-netwerk van Brussels South Charleroi Airport via Facebook of Google, ook het Beleid tot bescherming van de persoonlijke levenssfeer van Facebook of Google zal worden toegepast voor zover hun diensten worden gebruikt.

Elk geschil of meningsverschil met betrekking tot onderhavige Algemene voorwaarden, is onderworpen aan het Belgisch recht en valt onder de exclusieve bevoegdheid van de rechtbank van Koophandel van het gerechtelijk arrondissement Henegouwen, afdeling Charleroi.
